1. Agreement
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Renter", "you") and Franvek Inc. ("Franvek", "we", "us"), a company incorporated under the laws of Ontario, Canada, with its principal office at 120 Adelaide St W, Suite 2500, Toronto, ON M5H 1T1. By making a booking or renting a vehicle from Franvek, you agree to be bound by these Terms in their entirety.
2. Eligibility to Rent
- You must be at least 21 years of age at the time of rental
- You must hold a valid driver's licence issued in Canada or internationally (with an official English or French translation or an International Driving Permit if applicable)
- You must present a valid credit or debit card in your name
- Additional drivers must meet the same age and licence requirements and must be listed on the rental agreement before operating the vehicle
- Franvek reserves the right to refuse rental to any individual deemed unfit to drive
3. Reservations and Payment
Reservations can be made via our website, by phone or by email. A valid credit or debit card is required to secure a booking. The full rental amount, plus any applicable taxes, is collected at vehicle pickup. A security deposit hold will be placed on your card at the time of pickup and released within 5 business days of the vehicle's return, provided no damage or additional charges apply.
4. Pricing and Rates
All prices are quoted in Canadian Dollars (CAD) and include applicable taxes and basic insurance. Prices are as displayed on our website at the time of booking. Franvek reserves the right to modify prices at any time; however, confirmed bookings will not be subject to price increases.
5. Cancellations and Modifications
- Free cancellation: Cancellations made more than 24 hours before the scheduled pickup receive a full refund
- Late cancellation: Cancellations made within 24 hours of pickup may be subject to a fee equivalent to one day's rental charge
- No-show: Failure to collect the vehicle without prior notice will result in forfeiture of the full booking amount
- Modifications are accepted subject to vehicle availability
6. Vehicle Use
The rented vehicle may only be operated by the authorised renter and any additional drivers listed in the agreement. The vehicle must not be:
- Used for commercial transportation of passengers for hire (e.g. ridesharing)
- Driven outside the province of rental without prior written consent
- Operated under the influence of alcohol, drugs or any impairing substance
- Used in any illegal activity or in a manner contrary to applicable traffic law
- Driven off-road or on unpaved surfaces not suitable for the vehicle class
- Used to tow or push another vehicle without express written permission
- Smoked in (a cleaning fee of CA$250 applies for violations)
7. Insurance and Liability
All rentals include basic third-party liability insurance and collision damage waiver (CDW) as required under Ontario law. The renter remains responsible for any damage not covered by the included insurance, including damage resulting from prohibited use, willful misconduct or negligence. Enhanced insurance packages are available at an additional cost.
8. Fuel Policy
Vehicles are provided with a full tank and must be returned with a full tank. If returned with less fuel, a refueling service charge of CA$20 plus the cost of fuel will apply.
9. Late Return
The vehicle must be returned by the agreed date and time. A grace period of 30 minutes applies. Returns after the grace period will be charged at the daily rate prorated to the nearest hour.
10. Accidents and Breakdowns
In the event of an accident, the renter must: (a) stop immediately and ensure safety; (b) call emergency services if required; (c) notify Franvek within 24 hours at +1 (416) 600-1235; (d) obtain the names and contact details of all parties involved; (e) not admit liability. Franvek provides 24/7 roadside assistance for all rentals.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Franvek shall not be liable for any indirect, incidental, consequential or punitive damages arising from the use or inability to use the rented vehicle, except in cases of gross negligence or wilful misconduct by Franvek.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Ontario. If you are dissatisfied, we encourage you to contact us first at supp@franvek.com — we resolve most issues within 48 hours.
13. Changes to These Terms
We reserve the right to amend these Terms at any time. The version in effect at the time of your booking will apply to that booking. We recommend reviewing these Terms before each rental.
